Can DHHS use anything agenst someone after they turn 18?

My husband was accused of doing things to kids when he was 5, though they were only accusations and no proof. Then he was accused of something simaler when he was 11 but he spent 2 and a half years in a group home and went to counceling until he turned 18. Can DHHS use that agenst him in the custody case I am having with my ex? I am wondering because they took her from me and are now telling me I may have to get divorced for something he was accused of doing as a child but nothing was ever proved and he is willing to go to counceling again so that we don't have to get divorced. The thought of having to lose my husband or daughter is really upsetting me and I am trying to find any way possible to keep them both.
